This policy is for Hampton Group Holdings Pty Ltd t/as Finmax ACN 095 419 846 (“we,”, “us”, “our”), who is considered an Australian Privacy Principles (APP) entity, as defined in the Privacy Amendment (Enhancing Privacy Protection) Act 2012.

Who We Are and Our Main Function

Hampton Group Holdings Pty Ltd t/as Finmax ACN 095 419 846 is a finance broker. We provide access to a panel of financiers and offer a variety of finance products, both consumer and commercial, tailored to suit our customers’ needs and objectives.

We may also share information with our CRM provider, Campaign Monitor, and other service providers where necessary to operate our business.

What is Personal Information (PI) and What Kinds Do We Collect

PI is information or an opinion about an identified individual or an individual who is reasonably identifiable. Examples of the kinds of PI we collect include, but are not limited to:

  • Name, signature, residential, business or e-mail address, telephone number, date of birth, bank account details and expenditure details
  • Employment details, such as business address, contact details, job title and salary
  • Credit report information, such as credit history, credit accounts, repayment history, enquiries, defaults and bankruptcy

Sensitive Information can include information about an individual’s racial or ethnic origin, political opinions, religious beliefs, criminal record or health information. We do not collect health information as we do not offer insurance products.

How We Collect Your PI

In most cases, we collect your PI directly from you when you apply for a finance product (‘solicited information’). With your consent, we may also collect PI from third parties, such as employers, accountants, banks or referrers.

Why We Collect Your PI and Who We Disclose It To

We collect your PI to provide the finance products you request. PI is held for seven years after a finance contract ceases, after which it is deleted if no longer required.

We may disclose your PI to:

  • Financiers
  • Credit reporting bodies
  • Your employer, bank, solicitor or accountant to verify your information
  • The supplier (e.g., motor vehicle dealership) from which you are purchasing an asset
  • Your referees or contacts if we are unable to contact you

How We Deal with Individuals Who Remain Anonymous or Use a Pseudonym

You may choose not to identify yourself or use a pseudonym when contacting us generally. For finance applications, you must provide PI to support your application.

How We Deal with Solicited and Unsolicited Information

Solicited: We collect only information reasonably necessary for our main activity with consent. Sensitive information is collected only with consent.

Unsolicited: If we receive PI not solicited, we assess if it could be obtained lawfully and fairly. If not, or if it is unnecessary, we will destroy or de-identify it.

Notification of Collection and Use

We notify you when PI is collected directly or from third parties, explaining the purposes, who it is disclosed to, and how you can access or correct it or make a complaint.

Direct Marketing

We may use PI for marketing via email (Campaign Monitor), SMS, social media, and post. Opt out anytime via admin@finmax.com.au or 1300 13 27 27. Marketing stops within 30 days of request. PI is not sold externally.

Cross-Border Disclosure

We may share PI with affiliated organisations overseas, including Germany, New Zealand, United Kingdom, Philippines, India, Singapore, Japan, Malaysia, Vietnam, and the USA. Electronic storage may mean PI is held in other countries. We are not responsible for foreign law disclosures.

Government-Related Identifiers

We may collect identifiers such as Driver’s Licence, Passport, and Tax File Numbers. These are used for verification and de-identified when no longer required.

Accuracy and Security of PI

We take all reasonable steps to keep PI accurate and secure, including confidentiality agreements, system access controls, premises security, and electronic measures like firewalls and encryption.

Accessing and Correcting PI

You may request access to your PI. Exceptions include safety threats, legal restrictions, frivolous requests, or commercial confidentiality. If refused, we explain why and how to complain. Updates will be made upon request.

We aim to resolve complaints promptly. If not resolved in 21 days, we provide updates. Final resolution may take up to 45 days.
